I received a copy of your email message to Phyllis Beaulieu regarding the submission of an inspection report for licence NWB1JER0306. In you email, you state that this report is not part of DIAND's submission for the Jericho Diamond Project which is the subject of a public hearing to be held in Kugluktuk December 6 and 7, 2004.

We take note that this inspection report is not part of your Department's intervention. This being said, please be advised that this report has been placed in the NWB public registry for the Jericho Diamond Project, and will be made available to interested persons who will have the opportunity to review it and ask questions to DIAND, the Applicant, and other interested persons at the December 6, 2004 hearing. Indeed, this document is of particular interest to the Board since pursuant to s. 57(b) of the Nunavut Waters and Nunavut Surface Rights Tribunal Act, the Board may not issue a licence unless the applicant satisfies the Board that the financial responsibility of the applicant is adequate, taking into account the applicant's past performance. In this respect, an inspection report on an undertaking of the same applicant, currently licensed by the NWB, is considered admissible evidence for the purpose of s. 57 of the Act.
