Mineral exploration properties, including Kiggavik, are not considered businesses under the Investment Canada Act. The Kiggavik Project has not obtained an exemption under the Act and one is not required to complete the environmental assessment, subsequent licensing approvals or feasibility work. Under the Investment Canada Act and Non-Resident Ownership Policy and current Project ownership, an exemption would be required prior to production. AREVA has been active in Canada for nearly 50 years with a long term vision of continued, successful Canadian operations. AREVA obtained an exemption in the 1990’s prior to the operation of the McClean Lake facility in Saskatchewan and, should the Kiggavik Project advance with environmental assessment and other approvals, it will be developed in accordance with Canadian requirements. To: NIRB and AREVA Good morning, Nunavummiut Makitagunarningit has been operating under the assumption that AREVA obtained an exemption to the regulations under the federal Investment Canada Act concerning foreign ownership restrictions in the uranium mining and nuclear power generation industries. Could either NIRB or AREVA confirm this? If this is indeed the case (i.e if an exemption _has_ been granted), can you inform us when and by whom the exemption was granted, and if the exemption and the correspondence which resulted in the exemption are public documents -- and where they can be obtained? If this not the case, what changes in the Investment Canada Act (or in the regulations under the act) would be required to allow AREVA to proceed with its proposed Kiggavik project?
