Dear Mr. Frenette,

On September 28, 2011 the Nunavut Water Board requested further review 
comments from interested parties on Agnico Eagle Mines Ltd. (AEML) requset to 
amend the above-referenced water licence to allow drilling within thirty (30) 
metres of water and the noted conflict between this request and the Nunavut 
Impact Review Board (NIRB) Screening Decision dated April 21, 2011 (NIRB File 
11EN010).

In previous correspondence on this file from Aboriginal Affairs and Northern 
Development Canada (AANDC) dated August 30, 2011 to the Nunavut Water Board, 
it was stated that this request conflicts with conditions specified in the 
June 10, 2011 AANDC Land Use Permit, #2011C0010. The submitted written 
correspondence requested AEML to submit a written request to Ms. Tracey 
McCaie, AANDC Land Administrator Specialist, for permission to drill within 
the thirty (30) high metre ordinary high water mark zone and provide 
notification of any additional mitigation measures that will be implemented 
prior to, during, and following drilling operations to protect nearby water 
bodies. On August 31, 2011 you provided a response letter. Because this 
response letter does not request an amendment to the Land Use Permit and is 
not specific to the relevant Land Use Permit conditions, AANDC Land 
Adminstration cannot accept the submitted request.

I recommend that you submit a formal Land Use Permit amendment request to Ms. 
McCaie as soon as possible and that you ensure that the information being 
provided is adequate. Ms. McCaie can be contacted by telephone at 867 975-4283 
and by email at Tracey.McCaie@aandc-aadnc.gc.ca to further discuss this 
matter.
