Subject: RE: Water Licenses

Hi Dionne

Regarding both Boston (Water Licence NWB1BOS0106) and Windy (Water Licence no. NWB2HOP0207) construction has not commenced. At this point in time our plans would be to initiate construction no sooner than late spring of next year, more likely July. Thank you for pointing out the notification requirement.

Regarding the Goose water license, we have been in contact with Kinross and they are preparing the assignment form which we expect to be complete tomorrow. No construction on the berms has been initiated at the Goose project.

Thank you for your assistance in this matter

Regards,

John Wakeford

Hi John,

I was informed by Mr. D. Long that you were the contact for the Miramar properties in Nunavut with respect to the water licences.

In this regard I have several requests for clarification following receipt of an email from the NIRB requesting comments on a screening for self-berming containment at Boston, Windy and Goose.  I’ll address each site individually:

Boston: Could you clarify whether or not notification was given in accordance with the Water Licence NWB1BOS0106 under Part J.  (NWB does not have any record of this).  Has construction already been completed or started?

Windy: Same clarification request as above.  Water Licence no. NWB2HOP0207 Part B, Item 2.

Goose Lake: I was informed that new tank will be put in place at Goose lake. (Referring to letter dated Aug 24, 2004 To Mr John Stard from Biogenie Inc).  At present the water licence for the Goose Lake site is issued to Kinross Gold Corporation and is set to expire on December 31, 2004. The “sale or other disposition by a licensee of any right, title or interest in an appurtenant undertaking” requires assignment of the water licence.  The necessary forms are available on the NWB ftp site. http://ftp.nunavut.ca/     While the licence is not in Miramar’s name the water licence is set to expire at the end of this year and no renewal application has been filed.  It is unlikely that a renewal can be processed before the expiry date.

If you would like to discuss these issues further please do not hesitate to contact me or Phyllis Beaulieu, Manager Licence Administration.

Regards,

Dionne
