NWB4MAG0406 DFO requirements
Good afternoon Derrick,
I was speaking with Dionne Filiatrault this morning on the
4MAG Licence application and Draft. Most terms and conditions in the draft
have been finalized with the exception of Part C and the protection of water
(see attached).
With reference to your file NU-04-0041, It has been a
month since your letter was sent out requesting additional information needed to
complete the review on the subject licence application. I have been in
contact with Nick Arnalukjuak, Lands Administrator for the Hamlet over the past
few weeks, last time on the 15th of July, and although at that point he did not
have any confirmation that the information had been obtained, there was concern
expressed with respect to the limited construction season and the imminent need
for the licence.
In the draft licence, I have included a number of
terms/conditions under "Part C: Conditions Applying to the Protection of Water"
that have been included in other issued licences, presumably based on some of
DFO's previous comments and recommendations. Could you please have a look
at the attached and provide some input (comment/recommendations) based on the
premise that no harmful alteration, disruption or destruction of fish habitat
will result from the undertaking and that a fisheries authorization under
Sec.35(1) will not be required.

appreciated.
